OFFICIAL RULES GREAT GAS GIVEAWAY CONTEST
NO PURCHASE NECESSARY.
Contest Dates: April 28, 2011 – May 25, 2011
Winners: Forty (40) winners will be selected to win one (1) $75 gas gift certificate valid at any Stewart’s Shops location.
Participants must enter a keyword that will appear on CBS 6 news weekdays between between 5 and 6 a.m. and 6 and 7 a.m.
Entry forms must be filled out completely and received weekdays between 5 and 6 a.m. and 6 and 7 a.m..
Odds of winning depends on the number of eligible entries received.
LIMITATIONS OF LIABILITY: By participating in the Contest, contestants agree that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prize awarded, shall be resolved individually without resort to any legal action or administrative action of any kind whether in law or equity, to include a class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred but in no event attorneys' fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased, and any other damages, other than damages for actual out-of-pocket expenses.
CONSTRUCTION: The invalidity or unenforceability of any provision of these Official Rules shall not affect the invalidity or unenforceability of any other provision. In the event any such provision is determined to be invalid or unenforceable, the balance of these rules shall remain in full force and effect as if the invalid or unenforceable provision was not contained herein.
GENERALRELEASE: By participating in the Contest, contestants release cwalbany.com and any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any and all liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
SPONSOR: By participating in this Contest, contestants agree to be bound by these Official Rules and by all decisions of the Sponsor, WRGB. All decisions of WRGB relating to the administration of this CONTEST, including, without limitation, decisions relating to the eligibility of contestants, the award of the prizes, and the interpretation of these Official Rules, shall be final and binding in all respects. WRGB will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other Contest materials. WRGB reserves the right in its sole discretion to suspend, modify or terminate this Contest if necessary to comply with any federal, state or local law, ordinance or regulation, or if WRGB determines in its sole discretion that the integrity of the Contest has been compromised by fraud, tampering, unauthorized human intervention or other causes beyond the reasonable control of WRGB which threaten to corrupt or impair the administration, security, fairness or proper operation of the Contest.
WRGB and its affiliates reserve the right to substitute any prize with another prize of equal or greater value. Winners will be notified by daytime telephone or email. If a winner is unreachable after seven calendar (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If UPICKEM or its affiliates cannot find an eligible winner for the prize, that prize will not be awarded.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or its affiliates. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
WCWN and WRGB reserve the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.
Employees of WRGB and its respective parent, affiliates, subsidiaries, advertising sponsors, and promotional agencies, and the immediate family members of each are not eligible to participate in this contest.
WCWN and WRGB shall not be liable for lost or stolen entries, personal or property injury, losses or failure of providers in connection with awarding of this prize.
Contest is void where prohibited
Only one (1) entry per person, per round. There are two rounds per day.
No substitution or transfer of prizes permitted. (Inconsistent with your ability to substitute prizes)
Limited to one prize per office, household or family.
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
Entrants further grant to WRGB and Stewart’s Shops the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.
WRGB and Stewart’s Shops reserve the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or WRGB. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
UPICKEM and WRGB are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
All results posted are unofficial until winners respond to e-mail notification.
Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.
This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
WRGB reserves the right to change the rules at any time.
